Mersey Care NHS Foundation Trust formally acquired Liverpool Community Health NHS Trust on 1 April 2018.

Mersey Care also acquired Calderstones Partnership NHS Foundation Trust on 1 July 2016.

The majority of these payments were due to the running of a MARs scheme. 
Given the need to support the flexibility to address periods of rapid change and service redesign, it can be agreed that a limited Mutually Agreed Resignation Scheme (MARS) can be introduced.  A MARS scheme is designed to create job vacancies in the Trust that can be filled by redeployment from other jobs or as a suitable alternative job for those at risk of redundancy.
MARS is a time-limited scheme under which an individual employee, in agreement with their employer, chooses to leave employment in return for a severance payment.  A MARS is not a redundancy or a voluntary redundancy.  Several MARSs schemes have been offered since 2013.


2. Can the trust confirm that it adopted NHS policy of inserting a clause into compromise agreements to make it clear that workers or former workers are not prevented by compromise agreements from making public interest disclosures?


 The trust has made settlement agreements as detailed above but both Mersey Care and LCH employees were informed that they are not stopped from disclosing anything under the whistleblowing principles.


3. If so, when did the trust adopt this policy?


 Both Mersey Care and LCH adopted this policy in 2010


4. How many of the compromise agreements reached by the trust since 1 April 2013 contained a clause which made it clear that the worker or former worker in question was not prevented by the agreement from making public interest disclosures?


 All of them


5. If the trust has inserted such a clause into its compromise agreements, please provide a copy of the relevant clause.


In the Mersey Care compromise agreements:-


“For the avoidance of doubt, nothing in this Clause specifically and nothing in this Agreement generally, shall prejudice any rights that the Employee has or may have under the Public Interest Disclosure Act 1998 and/or any obligations that the Employee has or may have to raise concerns about patient safety and care with regulatory or other appropriate statutory bodies pursuant to her professional and ethical obligations including those obligations set out in guidance issued by regulatory or other appropriate statutory bodies from time to time”.


In the LCH compromise agreements:-


“For the avoidance of doubt, nothing in this clause 5 specifically and nothing in this Agreement generally, shall prejudice any rights that the Employee has or may have under the Public Interest Disclosure Act 1998 and/or any obligations that the Employee has or may have to raise concerns about patient safety and care with regulatory or other appropriate statutory bodies pursuant to his professional and ethical obligations including those obligations set out in guidance issued by regulatory or other appropriate statutory bodies from time to time.”


In the Calderstone’s compromise agreements:-


“Nothing in this Agreement will prevent you disclosing information:
• pursuant to any order of any Court of competent jurisdiction;
• which has come into the public domain otherwise than by a breach of  confidence by you or on your behalf; or
• for the purpose of making a protected disclosure within the meaning of  Part  IVA of the Employment Rights Act 1996.”

Long Term Sickness

Mersey Care NHS Foundation Trust provides adult specialist mental health, addiction, learning disability and community health services in North West England and beyond.

We provide specialist inpatient and community mental health, learning disabilities, addiction services and acquired brain injury services for the people of Liverpool, Sefton and Kirkby, Merseyside. We provide community physical health services in Sefton, secure mental health services for the North West of England, the West Midlands and Wales and specialist learning disability services across Lancashire, Greater Manchester, Cheshire and Merseyside. We are one of only three trusts in the country that provide these services.

Mersey Care are leaders within the geographical region for the psychological support of staff. Our Trust have an internal commercial level Employee Assistance Provider (EAP), Occupational Health and Physiotherapy Services and staff have access to a wide variety of support measures in place to support Health and Wellbeing, Physical and Mental Health.

Sexual Harassment

Mersey Care NHS Foundation Trust provides adult specialist mental health, addiction, and learning disability and community health services in North West England and beyond.  We are one of only three services that provide national high secure services.


1. May you please provide the number of recorded incidents whereby a staff member was found to have sexually harassed / sexually assaulted or raped patients. Please provide the figures per year within the following financial years: 2019/18, 2018/17 and 2017/16  

 
Due to the small amount of recorded incidents the trust cannot split the information into whether the incident was sexual harassment or assault.


There have been less than five cases reported over the period requested.


Therefore due to the small amount of recorded allegations, individuals could be identified. The release of this information could cause distress to the individuals concerned. To provide a breakdown of years is therefore exempt under 40(2) of the Freedom of Information Act 2000.


The sexual harassment cases were investigated but in most cases the complaint was withdrawn before the investigation was completed.

Mersey Care treats the safety of its staff, patients and visitors very seriously and when incidents happen there are rigorous procedures in place, together with a review of the events so we may learn from them. Staffing levels are reviewed regularly to maintain a safe and secure environment. Mersey Care works closely with the police to investigate allegations of a sexual nature.

Assaults of any kind in the NHS are unacceptable and we will continue to support those, who are often in difficult and challenging circumstances.
